Helmets. Who has to wear them?

While it's advisable when riding anything with wheels everyone should wear a helmet, who legally has to wear them? Well, when riding a motorcycle, everyone must. When riding a bicycle, scooter, skateboard, or roller skates, only those under 18 must. ...That’s the law. 🚴🏼‍♀️🏍🛵🛹

California Vehicle Code (CVC) 27803 requires riders of motorcycles, motor-driven cycles, or motorized bicycles to wear a Department of Transportation (DOT) approved safety helmet⛑, regardless of age. CVC 21212 states that anyone under the age of 18, whether a passenger or operator of a bicycle must wear an approved helmet. What about electric scooters? CVC 21213 says that no one under the age of 16 is allowed to operate an electric scooter, and those over 16yrs must wear a helmet.

Helmets are designed to protect your head🧠. Approved helmets have met the standards of the American Society for Testing and Materials (ASTM), the United States Consumer Product Safety Commission (CPSC) or the Department of Transportation (DOT). 🤕Head injuries account for the majority of serious or fatal cycle injuries and most crashes happen within 5 miles of home. In a crash, regardless of speed, the DOT says if you’re wearing an approved helmet you are three times more likely to survive a head injury vs. not wearing one.

You can’t just put on any helmet and think you’re safe. They vary from brand to brand and style to style. All helmets regardless of bike or motorcycle helmet should fit snuggly. For a motorcycle helmet, you’ll want to first measure your head and determine your head shape. This helmet should give you chipmunk cheeks, but not provide pain on your pressure points. All lining should touch the parts of your head they are meant to. You should not be able to chew gum or stick a finger easily between the lining and your head. For a bike helmet, the straps should form a “V” around the ears and rest on the chin without choking. Both helmets should rest flat leaving about a one to two finger space between the eyebrows and helmet. Your peripheral vision should not be impaired. If you can move your head easily under either style of helmet, it is not the one for you. Cracked or damaged helmets should be replaced as they have been compromised and will no longer provide adequate protection for you.

Helmet laws are enforceable on public roadways, bike paths, and trails. There are some municipalities who have made helmet wearing mandatory for all age ranges (i.e., El Cerrito and Bidwell Park in Chico). Private property is exempt. Parents of minors will be held responsible for any citations issued to their children for helmet violations, so parents stop letting your kids go out without one on.
And while we’re at it, we remind you it is illegal to ride (CVC 27400) or drive with earphones, ear buds, air pods, or whatever we’re calling them these days, in both ears. So, you’ll have to save the surround sound for the stationary bike at the gym.
